Shiftly — Professional Terms of Use

These Terms of Use ("Terms") govern your use of the Shiftly platform operated by Shiftly Technological Private Limited ("Shiftly", "we", "us", "our").
By creating an account, clicking "Agree & Continue", applying for a shift, accepting a shift, or otherwise using Shiftly, you agree to these Terms and our Privacy Policy.
1. Eligibility and account
You must be at least 18 years old and legally permitted and appropriately qualified to perform the healthcare services for which you apply.
You must provide accurate, complete and current information. You must not create an account using another person's identity, qualifications, licence, registration or documents.
You are responsible for maintaining the security of your account, OTPs and login credentials.
2. Shiftly's role
Shiftly is a technology-enabled healthcare staffing marketplace that enables healthcare establishments to post temporary, urgent, flexible and other staffing requirements and enables healthcare professionals to discover and apply for such opportunities.
Shiftly does not guarantee that you will receive, be selected for, or complete any minimum number of shifts or earn any minimum amount through the platform.
Unless expressly agreed otherwise in writing, creating a Shiftly account or accepting shifts through Shiftly does not by itself create an employment relationship between you and Shiftly.
3. Account access and verification
Shiftly may allow you to create an account and browse available shifts before all credential verification is completed.
However, Shiftly may prevent you from applying for, accepting, being selected for or working particular shifts until the credentials required for your profession, role or that particular shift have been submitted and verified.
"Shiftly Verified" means Shiftly has reviewed specified information or documents submitted through the platform. Verification does not constitute a guarantee of professional competence and does not replace any registration, licence, qualification or other legal requirement applicable to your profession.
4. Documents and credentials
Shiftly may request identity documents, educational qualifications, professional registrations, licences, certificates, experience documents and other information reasonably required to establish your identity and eligibility.
Professionals working in regulated roles may be required to maintain an active professional registration appropriate to their profession.
Additional credentials may be required for specialist, critical-care or other specific shifts.
You must promptly update Shiftly if any qualification, licence, registration or certification expires, is suspended, cancelled or otherwise becomes inaccurate.
Submitting forged, altered, borrowed, misleading or fraudulent documentation may result in immediate restriction, suspension or permanent removal from Shiftly.
5. Applying for and accepting shifts
You should apply only for shifts that you are appropriately qualified and reasonably able to perform.
Applying for a shift does not guarantee selection by the healthcare establishment.
Once you accept or are confirmed for a shift, you are expected to attend the specified healthcare establishment at the specified time and perform the agreed role for the agreed duration.
You may not transfer, subcontract or allow another person to perform a shift using your Shiftly account.
6. Check-in, attendance and completion
Shiftly may use check-in and check-out timestamps, geolocation or geofencing, healthcare establishment confirmation and other platform records to verify attendance and shift completion.
You must not falsify your attendance, location, working hours or completion status or attempt to manipulate Shiftly's attendance systems.
Where required, you must complete reasonable handover and check-out procedures before a shift is marked complete.
7. Professional responsibilities
You remain responsible for your own professional conduct and for performing services within your lawful scope of practice.
You must comply with applicable clinical, patient-safety, confidentiality, infection-control and workplace requirements of the healthcare establishment where you perform a shift.
Nothing provided through Shiftly constitutes clinical supervision, medical advice or authorisation to practise outside your lawful professional scope.
8. Professional payment
The professional compensation displayed for a shift represents the amount payable to you for the approved shift, subject to any valid adjustment relating to actual payable hours or a genuine dispute.
Under Shiftly's current payment model, the healthcare establishment is responsible for paying your professional compensation directly to you after verified completion of the shift, generally through UPI, bank transfer or another agreed payment method.
Shiftly's subscription fee is charged separately to the healthcare establishment and is not deducted from your displayed professional compensation under the current model.
Shiftly may allow or require you to confirm through the platform whether payment has been received.
9. Taxes
You are responsible for your own personal tax, professional and statutory obligations arising from income received for shifts, except where applicable law requires another party to deduct, report or account for taxes.
Shiftly may request PAN or other tax-related information where reasonably necessary for legal, compliance or reporting purposes.
10. Professional cancellations
Before accepting or being confirmed for a shift, withdrawing an application generally carries no penalty.
After accepting a shift, cancellation may be recorded as part of your reliability history.
Shiftly may distinguish between cancellations made more than 24 hours before a shift, cancellations within 24 hours, serious late cancellations close to shift start, and failure to attend without appropriate notice.
Repeated or serious late cancellations may result in warnings, reduced reliability status, temporary restrictions or administrative review.
11. No-shows
Failure to attend an accepted shift without reasonable notice may be recorded as a no-show.
Repeated serious no-shows may result in temporary suspension or administrative review.
Shiftly may suspend a professional after three serious no-show incidents, subject to review of the circumstances.
You may contact Shiftly to dispute an incorrect no-show determination.
12. Hospital cancellations
If a healthcare establishment cancels a confirmed shift, Shiftly will notify affected professionals where reasonably possible.
Shiftly does not guarantee compensation for time not actually worked unless a cancellation payment or other compensation is specifically displayed or agreed for that shift.
13. Reliability and platform history
Shiftly may maintain operational information including completed shifts, attendance history, cancellations, no-shows, credential verification and reliability status.
This information may be used for matching, marketplace safety, account review and healthcare establishment staffing decisions.
Shiftly may investigate and correct information where a genuine dispute is raised.
14. Patient and healthcare establishment confidentiality
You must keep confidential any patient, clinical, healthcare establishment, business or personal information obtained while performing a shift.
You must not improperly photograph, copy, publish, distribute, disclose or access patient records or confidential healthcare establishment information.
Patient-identifiable information must not be uploaded to Shiftly unless Shiftly specifically provides an authorised feature for that purpose and such processing is permitted by applicable law.
15. Prohibited conduct
You must not:
- impersonate another person
- submit false or fraudulent credentials
- manipulate attendance, working hours or location
- harass patients, healthcare establishment staff or other users
- engage in unsafe, fraudulent or unlawful conduct
- misuse patient or healthcare establishment information
- attempt unauthorised access to Shiftly systems
- share or misuse another user's account
- abuse payment, refund, complaint or reporting systems
- use Shiftly for any unlawful purpose
16. Suspension and termination
Shiftly may restrict, suspend or terminate an account for fraud, serious patient-safety concerns, forged credentials, repeated no-shows, misuse of confidential information, unlawful conduct or material breach of these Terms.
Where appropriate, Shiftly may allow the professional to provide additional information or request review.
17. Platform availability
Shiftly does not guarantee uninterrupted platform availability, a particular number of available shifts, selection for any shift or any particular level of income.
Temporary technical interruptions, maintenance and third-party service interruptions may occur.
18. Limitation of Shiftly's role
Healthcare establishments remain responsible for their workplace, patient-care environment, required supervision and payment obligations.
Professionals remain responsible for their professional and clinical conduct.
To the maximum extent permitted by applicable law, Shiftly is not responsible for losses resulting solely from conduct attributable to a healthcare establishment or professional that is outside Shiftly's reasonable control.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
19. Indemnity
To the extent permitted by applicable law, you are responsible for losses, claims or costs arising from your fraud, deliberate misconduct, false credentials, breach of confidentiality or material violation of applicable law or these Terms.
20. Complaints and disputes
If you believe information concerning attendance, payment, suspension, credentials, cancellation or another platform matter is incorrect, you may raise a dispute through Shiftly support.
Shiftly may review relevant timestamps, attendance information, platform communications, documents and information provided by both parties.
21. Changes to these Terms
Shiftly may update these Terms as the platform develops or where required by applicable law.
Material changes may be communicated through the app, website, email or another reasonable method.
Where appropriate, Shiftly may require you to accept an updated version before continuing to use affected services.
22. Governing law and jurisdiction
These Terms are governed by the laws of India.
Subject to applicable law, courts in Bengaluru, Karnataka shall have jurisdiction over disputes arising from or relating to these Terms or your use of Shiftly.
